Terms and Conditions
Please read these Terms and Conditions carefully before using Atmosphere software.
1. Acceptance of Terms
By using Atmosphere software owned by Innovare - Tecnología e Innovación A & Q, S.A., you agree to be bound by these terms and conditions. If you do not agree with any part of these terms and conditions, you may not use the software.
2. Payment for Content and services
Atmosphere allows users to purchase and access premium content and services through the platform. All payments made through the platform are final and non-refundable. By making a payment, you agree to pay the full amount as specified by Atmosphere and acknowledge that the payment is non-refundable.
3. License and Use of Atmosphere
Atmosphere is licensed under the GNU Affero General Public License v3.0 (AGPL) and is provided "as is" without warranty of any kind. You may use the software for any purpose, including commercial use, but you must comply with the terms of the AGPL. Please see the full text of the AGPL for more details.
4. Disclaimer of Liability
To the maximum extent permitted by law, Atmosphere and its developers and contributors shall not be liable for any damages or losses, including without limitation, direct, indirect, consequential, special, or incidental damages, arising out of or in connection with the use or inability to use the software, even if advised of the possibility of such damages. You use the software at your own risk.
5. Indemnification
You agree to indemnify and hold Atmosphere and its developers and contributors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the software, your violation of these Terms and Conditions, or your violation of any rights of another.
6. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Guatemala, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these terms and conditions shall be brought in the courts located in Guatemala City, and you hereby consent to the exclusive jurisdiction and venue of such courts.
7. Changes to Terms and Conditions
Atmosphere reserves the right to update or change these terms and conditions at any time without prior notice. Your continued use of the software constitutes your acceptance of the new terms and conditions. It is your responsibility to regularly check this page for any updates or changes. If you do not agree to the new terms and conditions, you must stop using the software immediately.
